These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User”, “Customer”, “you”) and Mad Priest Miniatures (“Company”, “we”, “us”, “our”), a business established and operating under the laws of Romania.

By accessing, browsing, creating an account, or placing an order through our website, you expressly acknowledge that you have read, understood, and agreed to be legally bound by these Terms.

  1. LEGAL FRAMEWORK

These Terms are governed by Romanian law and applicable European Union legislation, including but not limited to:

  • Romanian Civil Code
  • Government Emergency Ordinance No. 34/2014 on consumer rights
  • Law No. 365/2002 on electronic commerce
  • Law No. 449/2003 (as updated) regarding consumer guarantees
  • Regulation (EU) 2016/679 (GDPR)

Nothing in these Terms shall exclude mandatory consumer rights granted under Romanian or EU law.

  1. NATURE OF SERVICES

The Company provides physical products and/or digital products, including but not limited to STL files, 3D printable miniatures, digital assets, and related materials.

All digital products are licensed, not sold.

  1. ACCOUNT RESPONSIBILITY

If you create an account, you are solely responsible for:

  • Maintaining confidentiality of login credentials
  • All activities conducted under your account
  • Providing accurate and up-to-date information

We reserve the right to suspend or terminate accounts at our sole discretion where misuse, fraud, abuse, or breach of these Terms is suspected.

  1. DIGITAL PRODUCTS – LICENSE AND RESTRICTIONS

Upon purchase of any digital product (including STL files), you are granted a limited, non-exclusive, non-transferable, non-sublicensable, revocable license strictly for personal use unless a separate commercial license is explicitly purchased.

You are strictly prohibited from:

  • Reselling, redistributing, sharing, gifting, sublicensing, or uploading the files to third-party platforms
  • Modifying the files for the purpose of resale or redistribution
  • Using the files for mass production or commercial sale without explicit written authorization
  • Minting, tokenizing, or incorporating the files into NFTs or blockchain-based assets
  • Reverse engineering for redistribution purposes

Any breach of this section constitutes material breach and may result in immediate termination of license, account suspension, and legal action.

We reserve the right to monitor public platforms for copyright infringement.

  1. INTELLECTUAL PROPERTY RIGHTS

All content made available on the website, including but not limited to:

  • 3D models
  • STL files
  • Sculptures
  • Artwork
  • Logos
  • Branding
  • Text and product descriptions

is the exclusive intellectual property of Mad Priest Miniatures and protected under Romanian, EU, and international copyright law.

No ownership rights are transferred to you under any circumstances.

  1. PRICES, TAXES, AND PAYMENT

All prices are displayed in [Currency] and include VAT where applicable.

We reserve the right to:

  • Modify pricing without prior notice
  • Refuse or cancel suspicious transactions
  • Limit quantities per customer

Payment processing is handled by third-party providers. We are not liable for failures caused by payment processors.

  1. RIGHT OF WITHDRAWAL (CONSUMERS)

In accordance with GEO 34/2014, consumers have a 14-day withdrawal right for distance contracts, except in the following cases:

  • Digital content supplied on a non-tangible medium once performance has begun with prior express consent and acknowledgment of loss of withdrawal right
  • Custom-made or personalized products
  • Sealed goods unsealed after delivery where hygiene reasons apply

For digital products, by completing the purchase and accessing the download, you expressly consent to immediate performance and acknowledge that you lose your right of withdrawal.

  1. DELIVERY AND RISK TRANSFER

For physical goods, risk transfers upon physical delivery to the consumer.

Delivery timelines are estimates only. We are not liable for delays caused by couriers, customs, force majeure, or events beyond our reasonable control.

  1. WARRANTY AND LIABILITY FOR DEFECTS

Consumers benefit from statutory conformity guarantees under Romanian law.

Where a defect is confirmed, remedies may include repair, replacement, price reduction, or refund as provided by law.

We reserve the right to verify alleged defects before issuing remedies.

  1. DISCLAIMER OF WARRANTIES

To the maximum extent permitted by law:

  • The website and digital products are provided “as is” and “as available”
  • We do not guarantee uninterrupted or error-free operation
  • We do not warrant compatibility with all printers, slicers, hardware, or software configurations
  • Print results may vary depending on equipment and user skill

You assume full responsibility for use of digital files and printing outcomes.

  1. LIMITATION OF LIABILITY

To the fullest extent permitted by Romanian law:

  • We shall not be liable for indirect, incidental, punitive, or consequential damages
  • We are not liable for lost profits, business interruption, or data loss
  • Total aggregate liability shall not exceed the amount paid for the specific product giving rise to the claim

Nothing in this section excludes liability where exclusion is prohibited by mandatory law.

  1. PROHIBITED USES

You may not:

  • Use the website for unlawful purposes
  • Engage in scraping, crawling, data mining
  • Circumvent security measures
  • Upload malicious code
  • Infringe intellectual property rights

Violation may result in immediate termination and legal action.

  1. INDEMNIFICATION

You agree to indemnify and hold harmless Mad Priest Miniatures from any claims, damages, liabilities, costs, or legal fees arising from:

  • Your misuse of products
  • Your breach of these Terms
  • Your infringement of third-party rights
  1. FORCE MAJEURE

We shall not be liable for failure or delay in performance resulting from events beyond our reasonable control, including but not limited to natural disasters, acts of government, war, strikes, pandemics, supply chain disruption, or technical failures.

  1. DATA PROTECTION

Personal data is processed in accordance with GDPR and our separate Privacy Policy.

  1. TERMINATION

We reserve the right to suspend or terminate access to the website or digital licenses at any time where breach is suspected.

Obligations regarding intellectual property, limitation of liability, and indemnification shall survive termination.

  1. SEVERABILITY

If any provision is deemed invalid or unenforceable, remaining provisions shall remain fully effective.

  1. DISPUTE RESOLUTION

Any dispute shall be subject to the jurisdiction of competent Romanian courts.

Consumers may also use EU Online Dispute Resolution mechanisms where applicable.

  1. AMENDMENTS

We reserve the right to amend these Terms at any time. Updated versions will be published on the website. Continued use constitutes acceptance.
